Discovery in a Debt Case: What to Ask and When

Discovery is where debt cases are actually won — the collector must produce the documents or the case weakens.

The short version

Use written discovery to force the collector to prove the debt exists, that it owns the debt, and how the balance was calculated. The three targets are the original agreement, the chain of assignment, and the account history.
